Hire or Outsource Your Marketing? | Small Business Marketing ...

Saturday, March 31st, 2012

Sean Crafts at Mavenlink posted an interesting, info graphic style decision chart on his blog that he titled ?Should You Hire or Contract Your Marketing Department??

While many of the questions in the decision tree may not apply to small business marketing decisions (small business owners rarely start with budget) it does point out some good questions that you may not have thought of (how comfortable are you really with sharing proprietary information with people outside of your company?).

Here is a copy of Sean?s chart ? what do you think? What questions would you ask that he didn?t?

Pamela Hartigan: Inventing a New Future: Beyond Our Humpty Dumpty World

For the last few years since becoming director of the Skoll Centre, I have closed the Skoll World Forum with an Irish prayer. This year, I want to start my reflections with a riddle -- its origins of which I am not sure.

What is it that you keep forever when you give it away -- that changes as it moves from place to place -- and without which there is no past or future, no reason or meaning?

The answer? A story.

We are storytelling animals. Indeed many people believe that storytelling is what makes humans unique. We use stories to share our knowledge and experience, to learn from our past and to imagine our future. We only need to look at Nick Danzinger's wonderful work to see how true this is.

Oxford is a city of stories and those who have woven them -- Cornmarket Street in the city centre was the setting for the Crown Tavern where a young actor named Will Shakespeare grew rather too fond of his landlady. Sir Walter Raleigh learned his Latin at Oriel College, and the poet Gerard Manley Hopkins learned about beauty in Oxford's magnificent Baroque church. Oscar Wilde amused and amazed his examiners at the examinations schools where we will be tomorrow; and it was in Oxford one winter's night at 2 a.m. where J.R.R. Tolkien converted C.S. Lewis to Christianity. Oxford is the home of A.A. Milne whose characters including Winnie the Pooh, Tigger, Piglet and Eeyore still live with me today, as does Kenneth Graham's story of Mr. Toad and his wild ride in The Wind in the Willows -- and while I haven't followed Alice down the rabbit hole, I have followed her into Christ Church and to the dining hall which much later became a film set for J.K. Rowling's Harry Potter.

Oxford's associations spill beyond literature into history and legend. For more than a thousand years the city has played a central role in England's history, as a home and inspiration to kings and politicians, saints and bishops, artists and academics, inventors and industrialists whose stories have helped to shape our world.

Having been part of the Oxford community for three years, I often wonder what story will be told in 2812 about our current time, when the University of Oxford will double its current 800 year-old existence.

I wonder what that story will say about this period of unparalleled difficulty for our planet and for the people it hosts. How will it capture our mood of foreboding that deep and complex forces are rapidly reshaping the world as we know it? How will the story describe the new global landscape now surfacing and the national and global institutional arrangements now emerging to replace those that are proving to be inadequate to deal with the deepest problems we confront?

Currently, we are living in a Humpty Dumpty world where a good many of the king's horses and the king's men are scrambling to put Humpty together again -- while a growing movement of men and women with imagination, commitment, persistence and strong ethical fiber -- people such as each one of you gathered here for the Skoll World Forum -- are working furiously to ensure that the Humpty Dumpty model is transformed and replaced with pathways that achieve economic and social justice and arrest the destruction of our planet. We are in an interesting phase of new thinking and experimentation, and we must seize this hugely important opportunity.

Like most of you here, I am an optimist. I cannot imagine that our story will not have a happy ending, even while at times a happy ending seems to be a pipe dream.

Let's just review the stories that grabbed our attention in 2011. The year started with natural disasters including the earthquake off Japan that caused its tsunamis and nuclear disaster. In August, Hurricane Irene ripped through the Caribbean and along the east coast of the U.S., and with this storm system came the floods responsible for the deadliest U.S. tornado season since 1936. Then, in September, another earthquake struck Van in eastern Turkey killing 600 and leaving 60,000 homeless. And no one tuning into CNN or the BBC could escape the scenes of the monsoons that raged across Asia between June and November, killing untold thousands in Pakistan, Burma, Thailand, Laos and Cambodia. Typhoons battered the Philippines and Indonesia and few in Asia, including China, escaped the deluge crisis of this past year.

Moving on, the global financial crisis assumed urgent momentum in 2011. The stock market recovery of late 2010 and early 2011 was ephemeral, as many expected. The financial crisis took a definitive step as world markets plunged and as the sovereign debt crisis spread from peripheral states into the heart of Europe. The U.S. lost its AAA rating for the first time in history. In Europe, the tragicomedy of the DSK sex scandal was forgotten as the debt crisis spiraled. As, Greece, Ireland, Italy, Portugal, Spain and others have struggled to implement the austerity measures needed to refinance their debt -- the grand European project has teetered.

Meanwhile, the enormous levels of additional debt that the U.S. has taken on since the start of the crisis have been sustainable only because so much of China's foreign reserves are locked in to the dollar. Borrowing your way out of debt, as advocated by Keynesian solutions, works only if the present generation can pass its borrowings onto the next one. But with the aging of the developed world, the next generation will be smaller than the last, while the cost of energy and other commodities all continue to rise as emerging countries industrialize.

Add to this Iran's putative nuclear program, a world population that reached 7 billion, rampant inflation, food riots and a climate catastrophe.

This litany of gloomy stories is enough to give any Pollyanna pause for thought. Yet as described in Stumbling on Happiness by Harvard professor Daniel Gilbert, research in cognitive functioning find that human beings reinterpret negative things in a more positive light -- the "every cloud has a silver lining" idea.

My hope for the future springs from past and current personal experience. I was a university student in the late '60s, early '70s when ordinary citizens constituted the core of the anti-war movement and the civil rights movement. Globally, it was ordinary citizens who challenged the Chinese Communist system in Tiananmen Square, the apartheid structure in South Africa, and led the anti-nuclear movement, the environmental movement, the women's movement, and so on.

This past year, citizens' movements have risen to new heights in shaking the status quo, propelled by the newest technologies that connect them to one another around the world. In 2011, we saw people -- primarily young people -- take to the streets. The deeply democratic nature of the uprisings caught mainstream media and all of us by surprise as youth in the Middle East and North Africa rose up to demand freedom of expression and opportunities. Starting in Tunisia, the spark spread to Algeria, Egypt, Saudi Arabia, Syria and Libya, toppling long entrenched tyrants.

The movement spread to Europe where tens of thousands marched to express their frustration with the lack of employment, of opportunities, and of politicians who didn't seem to care, from "Los Indignados" or "the Outraged" in Spain, to Greece and then to the USA with the Occupy Wall Street movement and to the UK and the crowds gathered at St. Paul's in London. More recently, thousands in Moscow have taken on the Putin regime demanding the same things as protesters worldwide -- a systemic change that will provide greater dignity, transparency, participation and access to opportunities.

This movement of people worldwide is perhaps the most exciting global phenomenon of our time. It is our promise that we will not put Humpty Dumpty together again as before -- and for me, this is where entrepreneurial approaches to social change come in. These new approaches are the harbingers of the types of organizational and business models that our compartmentalized world so desperately needs in order to integrate where we make our money and where we do good, tear down the firewalls between our personal and professional lives, and reap the true value we all should be making to the world.

In sum, I am optimistic for many reasons, but mainly because for most of my life, I have hung out with creative and positive people who, regardless of their backgrounds and their resources, manage to punch way above their weight. So when one is surrounded by men and women with a "can do" attitude, an infectious energy, and an ability to see opportunities for innovation and transformation at every turn, it is pretty hard to be gloomy about the state of the world. Entrepreneurship of this sort is highly contagious.

I now work primarily with university and graduate students -- they are full of hope that they will find careers where they can contribute their business savvy and other talents to improve human welfare. They don't want to wait until they are 50 years old to "give back." Some are entrepreneurs themselves while others -- like young adults everywhere -- seek to contribute to endeavors that are fundamentally innovative, philosophically positive and morally compelling.

So how do we rewire our systems, our practices and our mindsets so our story reflects greater convergence rather than fragmentation of effort? That, for me is the great challenge before us, no matter where our life journey takes us. In that sense, the global movement of outrage on the part of ordinary citizens against an increasingly unfair and unsustainable society -- joined up with practical, creative and committed social entrepreneurs -- will ensure that Humpty Dumpty is not recreated -- and that when my story, your story, our collective story is told, it will be about depicting the triumph that occurs when human ingenuity, empathy and integrity rise to dominance together to address unprecedented threats.

Thank you.

Sony Music Unlimited

One of my biggest complaints with the Sony PlayStation Vita ($249.99, 4 stars) was its media playback abilities. It's a pain to connect to a computer, a pain to transfer songs, and a pain to make playlists. While that hasn't changed, there's now another option that puts loads of music on the handheld's touch screen with a much better interface. Sony Music Unlimited is the new music app for the PlayStation Vita, and it offers a library of millions of songs on demand if you're willing to pay $9.99 per month for the Premium membership. A Basic membership is available for $3.99 per month, but it lacks on-demand playback, library building, playlist building, and most other features that make the service worth a monthly fee. As an online service, Sony Music Unlimited also works through Web browsers, mobile devices, and the PlayStation 3, making it one of the most widely available music services by hardware platform. Unlike Editors' Choice Slacker Radio (4.5 stars) and Spotify (4.5 stars), Music Unlimited doesn't have a free option for listening to its music channels.

Works on PlayStation
Sony Music Unlimited works on a variety of platforms, but I mostly tested it on a PlayStation Vita and a PC with Google Chrome. Both platforms have a similar icon and list-based interface, with the Vita version understandably smaller than the Web version. In both cases, I was welcomed to the home page by rows of album art showing music recently added to my library, music I might like based on my choices, and new releases. The home page also offered, as links on the left side of the screen in Chrome and as a pop-up menu on the Vita, channels, music browsing, and playlists.

While the home page offers great recommendations based on what you listen to, the browse page lets you look at the top songs and albums by genre. There's also a selection of genre-based Internet radio shows, with some available in the Basic membership and some available only in the Premium membership.

Music selection is massive, and I found most of my favorite bands along with some surprisingly obscure metal bands on Music Unlimited, with a few puzzling exceptions. I found Incantation's full discography, one album each from Abruptum and Handful of Hate, and both albums from Pabst Blue Ribbon enthusiasts Red Fang.

Missing Music
I could only find two of Patton Oswalt's three major comedy albums, and there was no pure Queen to be seen anywhere in the library. There were plenty of covers of Queen songs and a Queen karaoke album, but no Sheer Heart Attack or A Night at the Opera. Even Led Zeppelin got snubbed, only getting an audio documentary in the library. If you want to listen to metal, comedy, or modern? pop music, Music Unlimited is the service for you. If you want to listen to the greatest rock bands of all time, you'll need to buy the albums. This is likely every bit an issue on the part of the license holders of the bands' music than it is Music Unlimited itself.

Sound quality is excellent on both the Vita app and the Web page, with songs loading quickly over both Wi-Fi and wired connections. Once songs started, they didn't skip and played straight through with no wait for buffering.

Sony Music Unlimited would be just another solid streaming music service, but PlayStation 3 and PlayStation Vita support makes it especially appealing for music-loving gamers. While PS3s and Vitas aren't quite as widespread as iTunes and iOS devices, the option to have streaming, on-demand music on them is appealing for many gamers who use their PS3s as their main home theater device. While its classic rock selection has massive holes, there are still millions of songs and thousands of bands and albums to discover and listen to on demand.

Successful Business Through Web Site Design | Earning Money ...

When we contemplate the power of internet selling, a lot of us appear to believe that anything we post for sale in the World Wide Web will automatically magnet clients. It is one of the main reasons why some websites do not come through. Our websites will only present and advertise products and services successfully if we assign the suitable things in them.

The internet is immense and powerful, but only to those who know how to utilize it. You cannot expect all internet users from all over the world to view and purchase your products. Only a really modest percentage of the millions of internet users actually shop for products from the World Wide Web, and an even smaller part of those who purchase items that they find by chance. When consumers look up the internet to shop, they already have a thought of what they want to buy. Thus, a website must captivate the interest of clients and make them remember about the company should they plan to buy the kind of product in the future.

Advantages Of Professionally Designed Internet Site.

A professionally designed internet site has its benefits. You can be certain of the quality- both in visual presentation and substance. It contains all significant information and delivers them in a visually pleasing style.

There is a stiff contest between websites in the internet, primarily due to their big number. After all, people commonly view the first few sites that come out of search results. Professional website design companies help in optimizing the popularity of your company website by making them web-spider favorable. They use advanced indexing programs that help web pages to come out automatically on relevant searches and rank better on search engine pages.

The website could tell either success or failure of a company?s internet drive. Make sure you improve your website?s advantages and gains by commissioning a professional web site design company. An advantageous web site company improves the website?s chances of success by making it useful and visually appealing to users and potential clients.

Tech firms cry foul in Taiwain

High-tech firms in Taiwan say they developed numerous firsts like all-in-one PC computers that became market successes only after being rebranded in the United States, Japan, or South Korea.

? A local, slice-of-life story from a Monitor correspondent.

A lawsuit by a little-known Taiwanese high-tech firm against Apple has joined the list of uphill legal cases against Silicon Valley.

Working on computer hardware contracts for 30 years, Apple?s onetime partner Proview International Holdings alleges ?fraudulent actions? by the computer giant to acquire iPad trademarks. But Proview?s would be just one case. High-tech firms in Taiwan say they developed numerous firsts that became market successes only after being rebranded in the United States, Japan, or South Korea. Proview?s claim joins that of Taiwan-based Elan Microelectronics, which sued Apple in 2009 over patents for the touchpad.

In addition, several Taiwanese firms claim to have come up with the ?all-in-one? compact desktop computer in 2007 only to find it sold later by Apple and Lenovo, says Helen Chiang of market research firm IDC in Taipei.

Taiwan lags behind overseas peers because its tech firms, facing slimmer profits from contracts, only started branding their own PCs within the past five to 10 years, the Taiwanese government and private analysts say.

?The problem isn?t with product functions or technology,? says Hanson Tseng, strategic marketing executive director with the Taiwan External Trade Development Council. ?It?s about whether the brand can be advanced.?

James bulger and the video recordings

James Bulger And The Video Recordings Act 1984

An analysis of the effect moral panics have on the law through criminal cases begins with James Bulger's murder in 1993. The Sun newspaper described the case as that horrific it ?highlighted moral decay in Britain.' The BBC called it a "landmark case," it came to symbolise a moral panic about deviancy and children - ?the threat of other people's, the defencelessness of our own.' This chapter will illustrate how the case has impacted upon the law in various areas; through CCTV scheme implementation, video recording regulations and juvenile sentencing. This influence will be shown through changes in legislation, as well as using supporting evidence such as reports and journals which relate the case to the formed regulations.

On the 12th February 1993, two year old James Bulger was abducted from the New Strand Shopping Centre in Bootle by two ten year old boys, Jon Venables and Robert Thompson. Two days later James' brutally mutilated body was found on a railway line. By the 20th February, Venables and Thompson were charged with his abduction and murder. It slowly began to unfold the extent of the various injuries inflicted to James' body by the two boys, as they tortured him before finally abandoning his body on a train track. Venables and Thompson were to be the youngest defendants in history to be convicted of murder.

The case was the first one ever to be aired on the programme ?Crime Watch' the same week as it had been committed, with the Ministry of Defence offering assistance in enhancing CCTV footage of the suspects abducting James to aid enquiries, giving an indication to how high profile the case was in public agenda. The impact the case had on Britain was one of stirring paranoia and fear, parents were afraid their child would be the next one to be abducted, with child's safety reign sales increasingly rapidly after James's abduction. The case has recently been pushed back into the attention of the media due to the re-arrest of the defendant Jon Venables on allegations made concerning breaches of his release on life licence.

The trial took place at Preston Crown Court due to the amount of unrest caused towards it in Liverpool. This suspects were labelled as ?evil,? combined with the media's reaction to the case as more details came to light creating a presentation of two young children as wicked; ?no further inquiry was necessary as to the causes of criminality in the young, all that matters were that they were guilty'. Few considerations towards the fact they were children were taken throughout the trial. It was later ruled in the European Court of Human Rights that Britain was guilty of three breaches of human rights in the trial and sentencing of Thompson and Venables through the massive emotionally driven media response to the case being severely intimidating towards the defendants, impairing the possibility of a fair trial. The sentence for the two defendants had been increased to 10 years form 8 by the lord chief justice, Lord Taylor of Gosforth. This was follow by a petition of 280'000 signatures conducted by The Sun newspaper, created with the intention to increase the custody sentence of the two defendants. Home Secretary Michael Howard granted this by increasing the maximum sentence to 15 years, a direct example of how the media has played a part in sentence tariff change. There had been refinements made to the tariff policy previously in 1998 and 1991 but no application was made to child offenders in the Parliamentary statements, until July 27 1993, when Michael Howard stated ?everything..said about the practice of the Secretary of State in relation to mandatory life sentence prisoners applies equally to persons who are, or will be detained during Her Majesty's pleasure.' This statement was made between the murder of Bulger and the trial of Thompson and Venables, which implies it was intended to appease the significant public opinion indicated by The Sun's petition towards this specific case. Michael Howard made it clear that this policy would be applied to Venables and Thompson just as it would be applied to an adult murderer.

The link between the two murderers and media violence began with a remark made by the trial judge; ?I suspect that exposure to violent video films may in part be an explanation.' This remark evolved into an application of blame to a ?slasher' horror film Child's Play 3, that the boys ?may' have watched. The link to Childs Play 3 was that the father of one of the boys - Neil Venables - had rented the video some months earlier; however the police officer who directed the investigation, Albert Kirby, found that the son, Jon, was not living with his father at the time and was unlikely to have seen the film. Moreover, the boy disliked horror films - a point later confirmed by psychiatric reports. Thus the police investigation, which had specifically looked for a video link, concluded there was none. This fact received very little coverage and the lasting impression is of the newspaper campaigns in November 1993 blaming violent videos for the toddler's murder'. The panic and outrage felt by the public at the child killers was turned onto media violence; the violence depicted through mediums such as film are suggested to be the cause and inspiration for a crime, wanting to pin James Bulger's murder onto the video. The Sun staged a public burning of horror videos begging the public to ?for the sake of all our kids...burn your video nasty,' Video stores began to withdraw the film from its shelves in fear of outcry from the public, one video chain burnt its copies as part of The Sun's campaign. It was later revealed four months later by the Merseyside police that there was no evidence to suggest either boy had watched Childs Play, or any horror film like it. This ?snow ball effect' sparked by the passing remark of the judge turned into a national outrage at the film., illustrating just how strongly the British public felt about the case. There was a need to find a cause for this horrific crime, a ?scape goat' for the blame, and measures needed to be put into place to prevent it happening again.

A report written by Professor Elizabeth Newson was commissioned to be written by liberal democrat MP David Alton to support his argument for an amendment to be made to the Criminal Justice Bill for videos to be classified as ?Unsuitable for Home Consumption' (UNHC), preventing children from viewing unreasonably violent videos at their leisure. He demanded that modifications be made to the law to effectively remove all horror films from distribution in the UK. State censorship was implemented in the realms of the courts and the Obscene Publications Act before then being embodied in the Video Recordings Act of 1984. The Video Recordings Act was amended after section 4 with a new legal requirement within Section 90(1) The Criminal Justice Act 1994 for the British Board of Film Classification (BBFC) to;

?Have special regard among the other relevant factors to any harm that might be caused to potential viewers or, through their behaviour, to society, by the manner in which the work deals with:

For failing to apply the criteria with a sufficient regard for the factors listed, the BBFC could now be taken to court and held accountable. The mention of ?other relative factors' gave the BBFC the ability to also consider other criteria not listed such as bad taste, offensiveness or bad language. These amendments to the existing guidelines strengthened the classification system of videos. The criteria themselves are listed in very broad terms in their descriptions and what could be deemed offensive through their portrayal in video. The terminology used of ?any harm that may be caused to potential viewer or, through their behaviour, to society' is vague in its application; possibly being applied to ?harm' caused to the viewer through disturbing and shocking them, or maybe causing more long term damage psychologically. Previously triable summarily only offences such as supplying or possessing unclassified video recordings were made triable either way under section 88(2) and 88(3) of the 1994 Act, showing an acceptance these offences are of a serious nature, warranting this change. The Home Secretary also reserved the power to enable the BBFC to review video recordings ?in relation to such determinations as the authority think fit.'This broad provision means that videos already held a classification could be reclassified as suitable for an older age group only or even refused a certification altogether.

The criteria for suitability incorporated into section 4A of the V.R.A. will have application only to video classification decisions taken by the BBFC after the 1994 Act came into force, i.e. after November 3, 1994, but the Home Secretary has reserved a power in the legislation which will enable the BBFC to review works already classified prior to the introduction of these criteria.21 If this power is taken up, it might be anticipated that some videos which currently hold a classification certificate will, after review, be refused a certificate, whilst others may be reclassified as suitable only for an older age group.

In Newson's report, claims where made that up to that point it had been underestimated just to what extent these violent films were being accessed by children, with Newson making links to violent behaviour from heavy exposure to media images, which result in a desensitisation to compassion, as displayed by the two defendants in the Bulger case ;

?We know that children can be traumatised, not only by the images they see, but also by additional images that are suggested by their imagination in response to the originals; but far more dangerous, because more lastingly damaging, would be that eventually they should no longer be troubled at all by seeing violent images, as a result of desensitisation by systematic repetition. The processes of ?desensitisation? and ?flooding? are well known methods for modification of behaviour, reducing the impact of the original accompanying emotion.'

The Newson report has been described as ?wildly misleading' for its founding of evidence being of poor quality and its emotive use of the Bulger case to support its argument. Newson uses the ?protection of children' to strengthen her argument in the paper;

?it seems impossible to allow the situation to continue, and indeed escalate, as it now is. ..it seems unlikely that those who feel responsibility for protecting children will be able to wait for such corporate self-denial.'

Children in society are used here to strengthen the argument through individuals' innate need to protect and care for them; an illegitimate use of feelings to make a case for a cause. Not long after the Newson report was released the Gulbenkian Foundation commissioned a report; Children and Violence, which was published in November 1995.

The case of Jamie Bulger not only impacted upon the publics' perception of the ?Video Nasties' moral panic, but also the possible use of video surveillance in Britain as a crime prevention measure. Leon Hempel, a social scientist at the Centre of Technology and coordinator of the Urban Eye project stated ?The intense media attention afforded to the case played on the growing paranoia present in Britain.? At the time of James Bulger's kidnapping in 1993, there were just 10 systems active in Britain, by 2005 there were 4 million cameras installed, a total higher than any other country in Europe. CCTV imaging played a significant role in the Bulger case when it was used in the trial as evidence to show images of the two defendants Jon Venables and Robert Thompson abducting James Bulger from a Liverpool shopping centre (see attached bibliography for image; appendix A). This was at first the only major lead into identifying the suspects. Hempel stated, ?The Bulger case was instrumental in the rise of video surveillance systems across Europe, the case persuaded the British public of the advantages of having video surveillance cameras in public spaces and the effectiveness of systems in preventing crime.' Professor Laycock, director of the Jill Dando Institute stated the familiar image of the two defendants leading James Bulger out of the shopping centre is one that was key to the case, ?it showed the police they were looking for two kids rather than a paedophile.? Less than a year after the Bulger case, Liverpool city centre's own large scale CCTV system went live, which can be viewed as a direct reaction to the murder of James Bulger. But research carried out on 14 systems on behalf of the Home Office actually shows CCTV does little to reduce crime or make people safer. Chief inspector Kevin Wellden of Middlesborough Town Police sees the technology of CCTV as more of an asset to the police,

In 2002, Lord Falconer unveiled one of the largest CCTV systems to cover Manchester city centre, commenting that CCTV helps give the public peace of mind that they are more secure, acting as an aid to the police in apprehending wanted individuals and in securing convictions in court. A report carried out by the National Association for Care and Resettlement of Offenders (NACRO) concluded that the CCTV system, as well as schemes put in place in housing estates, on public transport or car parks, had no effect into reducing street crime. NACRO have claimed that although CCTV is a useful aid to the police, its effectiveness is often over stated in its use as a crime prevention method.

Another aspect of CCTV that cannot be controlled is its misuse; an advisory body called Camera Watch chaired by Gordon Ferrie, a former senior police officer, found up to 90 percent of CCTV systems present in the UK fail to comply with the Information Commissioners UK CCTV code of practice, with many operating illegally; ?we are in favour of close circuit television, it's as good as having DNA. There is nothing better than actually seeing someone commit the crime. All we're asking is that the images that are taken are compliant with the Data Protection Act.?

The issued raised by the reactions displayed to the case of James Bulger highlights many aspects of how the media can influence the public perception of a social issue, but specifically the damage that has been caused by this moral panic. Traditional British views on childhood were lost, children were being monitored far more closely than ever before, with the real and very rare incident of two child killers being represented and used as an example of moral downfall in society. The news coverage of the crime was such that it implored people to support the campaigns and if you weren't a supporter you were condoning the defendants' actions in killing James Bulger. Jenny Bargen of the Department of Juvenile Justice warns the high profile case resulted in a ?public damning', distracting the justice system and the public from helping the offenders and the family of the victim.

?It's disturbing that young people are involved in killing someone. It always has been. But it does not mean that suddenly it is not safe to walk the streets, there are programs designed to help juvenile offenders to understand what they have done and help them to grow up.?

The intense media coverage of the child killers was so extensive that it could have given the impression to the public that the actual occurrence of such crimes was increasing. Between 1979 and 1994 there were 108 children between the age of 10 and 17 convicted of murder or manslaughter in England and Wales, a very small amount compared to the perception given by the mass coverage which will be shown to have a direct impact on the public opinion. The Guardian newspapers leader comment response to the ruling for Venables' and Thompsons' case said the murder had ?unlocked all kinds of primitive fears about the aggressive urges in young children', but also lead on to caution against using James Bulger's murder as ?an excuse for reversing 10 years of criminal justice policy. A system designed to deal with five million crimes must not be steered by one.' The question of how successful the rehabilitation could be of the two defendants has been brought into the foreground of the media recently due to Venables' re-arrest after a breach of his life licence conditions, but it must be remembered this one case is not applicable to all; with reference being made to the case of Mary Bell, who was released ?on licence' after serving 12 years now lives AAA

In the appendix of her book, ?The Case of Mary Bell,' Gitta Sereny describes the backgrounds of the two defendant's Venables and Thompson. This history contains Thompson's abandonment from his father and Venables as a school child displaying seriously disturbing behaviour. The sexual element of the crime, with the manipulation of James Bulger's foreskin is considered, with Sereny noting; ?children who abuse other children have almost invariably been abused themselves.'/ Gitta Sereny observes that to enable people to gain an understanding of why these terrible deeds occur, it is the only change we have of ever perhaps stopping even some of them taking place in the future. ?Horrible things will always happen, but to understand them could prevent some.' This argues for focus to be aimed at minimising future crimes through looking at providing support where it is needed through rehabilitation, not just to achieve retribution for the crime. The law relating to diminished responsibility, a defence to manslaughter, does not account for children who sexually abuse children or acknowledge that these abused children could be suffering from an ?abnormality of the mind.' In an interview with The Guardian newspaper, the foreman of the Bulger jury, Vincent Moss stated that ?looking back, I am ashamed that I allowed myself to be coerced by the judge and prosecution to agree to a verdict of guilty of murder.' Moss says ?a proper judgement would have been that they had behaved like confused, frightened and stupid children caught up in a situation they had created but could not deal with. The judge's pronouncement that they were ?evil? was just wrong - they didn't have the moral and intellectual capacity for this to be an accurate description.'

The case coming back into debate has resurrected the emotive responses of the public, but also highlighted an important and overlooked issue; victims and their families should have more rights within the system, in particular their access to information. A spokesman for Victim Support commented on the Bulger case, ?It is a severe example of a general problem that affects a lot of victims of crime, which is not being given information about what is going on.?

The Newson report has been regarded retrospectively as being quite biased in its conclusions which are accused of being based on weak research, being a result of child behaviourists falling into line with the current fad of that time to see a link between video violence and antisocial behaviour and ignoring evidence that does not fit in with the theory. One psychologist who signed to the Newson report was quoted saying ?In the past, many of us thought there could be a link but the evidence was not terribly convincing and not enough to make us question the freedom of an individual to have access to this material. The Bulger case made us think again.' However, the Gulbenkian Foundation's report does bring to light the importance of taking into account many other factors such as particular children's' direct experiences of violence in their homes, or the ecological surroundings of the children, not just orientating towards the one issue of video violence; ?A useful debate about causes and prevention of violence involving children is hindered by the sort of misinformation about the role of particular videos which followed the Bulger trial.' This is how a misleading representation can lead to changes in the law such as those that took place under the Video Recordings Act 1994 because of the Newson report and the change in the minimum tariff for life sentences. The changes made to the Video Recordings Act 1994 to strengthen controls over video recordings intend to implement strict standards of classification, but the extent to which these standards will be tightened is reliant on the interpretation of the BBFC. Through making the video classification offences subject to a sentence of imprisonment, there is an underlying recognition that these offences merit custodial sentences, and are therefore serious offences. The power reserved by the Home Secretary to allow the BBFC to review videos already classified prior to the new standards means it anticipated some videos already holding a classification certificate will, after review by the BBFC, be refused a certificate or be reclassified within another older age classification.

Ryan Gosling Takes A Beating (Not Really) For 'Only God Forgives'

Ryan Gosling came out of his last Nicolas Winding Refn movie, "Drive," pretty much unscathed. Sure, he took a knife in the gut near the end, but that didn't stop him from driving off into the sunset to some retro-sounding synth music. It doesn't look like he'll be so lucky for his next Refn movie, [...]

MAN-MAKING: Males and Relationship Violence

About a month ago, my niece was killed by her husband in a murder-suicide. Yes, my family and I are still in shock and working through it. This post is a gesture dedicated to this tragic couple. It's offered with the hope we can all learn something about what went wrong. It's also offered with the hope more people will learn about the issues and then teach young males about abusive and controlling relationships. The quote by Fredrick Douglass, It is easier to build strong children than to repair broken men, was never more true than with this issue.

The very short story is my niece was full of life, creative, attractive, and engaged in the world. Her husband was unemployed, overweight, friendless, isolated, and depressed. In truth, he was a lost man-boy who was leaking self-esteem at a breathtaking rate. Toward the end, the only thing he had going for him was the control he had over his vibrant but vulnerable wife.

We kind of got the feeling that things between them were out of sorts. On the times in the last few years we were able to get together, their behavior was odd. He was dressed inappropriately, was sarcastic and demeaning towards our niece. In front of us all, he would speak badly of her, her parents, and many of the rest of the family. She would occasionally bite back, but was pretty quickly shut down. It was increasingly uncomfortable to be with them, but they put on a happy face, and we couldn't tell how tragically deep the problem was.

At our last meeting with them, he announced for health reasons, it was necessary for her to give up coaching her BMX racing team. This was way off because it had been her joy and passion for many years. We mentioned all the kids who would miss her involvement, but didn't say anything about her decision. He also said that because of the stress she was under, it was necessary for him to step in and manage her finances. She seemed uncomfortable with the idea, but didn't challenge him, and was apparently willing to let it all go. From that time on, it got harder to reach her by phone, and we realized he would often, and increasingly, answer her emails. I think the family rationalized all couples have challenging times, and didn't act to intervene. We were prepared to hear about tough times, but we never thought the family would get THAT call from the police.

Since their passing, we've all learned so much of what we were experiencing with them were common symptoms of an abusive and controlling relationship. As is the case in deep and wet grief, everyone in their circle of family and friends is sharing a small mountain of woulda, coulda, shoulda's. Had we only known what we know now, they both might still be alive. So let me share with you just a little of what you, young males, and everyone else really should know:

  • Relationship violence can be defined as a pattern of behavior used to gain or maintain power and control over an intimate partner.
  • ?
  • Abuse in relationship can be physical, sexual, emotional, economic or psychological actions or threats of actions that frighten, intimidate, terrorize, manipulate, hurt, humiliate, blame, injure or wound someone.
  • ?
  • These forms of violence can happen to anyone, at any age, of any race, sexual orientation, religion or gender. It can happen to people of all socioeconomic backgrounds and education levels, and couples who are married, living together, or those who are dating.
  • ?
  • Teens are seriously at risk for dating violence. Research shows that physical or sexual abuse is a part of 1 in 3 high school relationships (http://goo.gl/0JGWD).
  • ?
  • While there is no question some men are abused by their intimate partners, battering and other forms of relationship abuse is largely a male on female issue. According to the U.S. Department of Justice, 95 percent of the victims of domestic violence are women. The National Crime Victimization Survey consistently finds that no matter who initiates the violence, women are 7 to 10 times more likely to be injured than are men. This is why our young males need to learn about both destructive and healthy relationship dynamics early on.
  • ?
  • There is a predictable and addictive cycle of abuse in "power and control" relationships that revolves around anticipating violence; coping with actual acts of violence; or recovering from the violence. Once set in motion, the cycle can usually only be broken with awareness and professional help.
  • ?
  • This PDF describes a 2002 study of females killed with a firearm. Almost two-thirds were killed by their intimate partners.
  • ?
  • If a friend, date or intimate partner has a history of behaving in the following ways, it may indicate you are in, or headed for an abusive relationship:

Calls you names, insults you, or continually criticizes you.
Does not trust you and acts jealous or possessive.
Tries to isolate you from family or friends.
Monitors where you go, who you call, and who you spend time with.
Does not want you to work.
Controls finances or refuses to share money.
Punishes you by withholding affection.
Expects you to ask permission.
Threatens to hurt you, the children, your family or your pets.
Humiliates you in any way.?

I guess what's really important for me to say is if you or someone you know is caught up in a relationship with these dynamics, PLEASE do something. At the minimum, check out your feelings with a caring "advocate" who will answer the phone at the National Domestic Violence Hotline: 800.799.SAFE (7233). They are available 24/7, and will talk with any person affected by relationship violence, including abuser, victim, friends, family, co-workers, classmates, etc., regardless of your age, sexual orientation, or even the language you speak (170 languages available).

The American Bar Association has a great website describing a broad swath of data on domestic violence statistics covering various ages, ethnic groups, and much more. None of it is pretty. I found their section on teens to be especially enlightening.

You can easily learn more about this issue by searching for "Power and Control Wheel" on the web, and you'll come across lots of good information. One solid organization (of many) working in this field is DAIP, Domestic Abuse Intervention Programs. They have very good "Power and Control Wheel" and "Equality Wheel" diagrams. These are great learning/teaching tools for quickly describing both the behaviors in abusive relationships as well as what a healthy, power sharing/supportive relationship can look like. You may want to consider engaging an organization like DAIP to train a group of young people about these issues. However, printing out the wheels and having a conversation with a young guy or guys you know would be doing a lot.

I know I'm rambling on here. Because of my still raw feelings, I'm guilty of over-trying to keep others from woulda, coulda, shoulda's. It's my prayer that you, or someone you know, will never experience what my family has been through.

When confronted in some way with abuse, power, and controlling in relationship, please, please do something. And then let's help the next few generations of men be the best possible relationship partners possible.

(AP) ? The Supreme Court is taking up the key question in the challenge to President Barack Obama's historic health care overhaul: Can the government force people to carry insurance or pay a penalty?

The justices hear extended arguments on that topic Tuesday. It's the linchpin of the law's aim to get medical insurance to an additional 30 million people, at a reasonable cost to private insurers and state governments.

Virtually every American will be affected by the outcome, due this summer in the heat of the presidential and congressional election campaigns.

The administration says Congress has ample authority to impose the requirement that most people carry insurance or pay a penalty. Twenty-six states and a small business group trying to get the law struck down call the insurance requirement an unprecedented power grab by Congress.

They say that not even decades of high court rulings that endorsed an expansive view of congressional authority can support the health care law.

If upheld, the law will force dramatic changes in the way insurance companies do business, including forbidding them from denying coverage due to pre-existing medical conditions and limiting how much they can charge older people.

The law envisions that insurers will be able to accommodate older and sicker people without facing financial ruin because its most disputed element, the insurance requirement, will provide insurance companies with more premiums from healthy people to cover their increased costs of care.

White House press secretary Jay Carney, traveling Tuesday with Obama in South Korea, reiterated the administration's contention that the health care law is constitutional, noting that the individual mandate provision had support among Republicans. However, Carney said, "The president feels that this is something for the court to decide, not for us to weigh in on directly."

The law also dramatically expands the state-federal Medicaid program for low-income Americans, with the federal government covering almost all the additional costs.

On Monday, the justices signaled they are ready to confront the big issues in the case, appearing to reject the contention that it was too soon for a decision. Audio of Monday's argument can be found at: http://bit.ly/GSXEpf.

A 19th century law bars tax disputes from being heard in the courts before the taxes have been paid. The law could apply to the health care case because the insurance requirement doesn't kick in until 2014 and any penalties will be paid along with federal income tax on returns due by April 2015.

Solicitor General Donald Verrilli Jr., defending the health law, urged the court to focus on what he called "the issues of great moment" at the heart of the case. The states and the National Federation of Independent Business also want the court to go ahead and decide on the law's constitutionality without delay.

Administration officials involved with the defense and implementation of the health care law, Attorney General Eric Holder and Health and Human Services Secretary Kathleen Sebelius, were in the courtroom Monday. Republican Sen. Jeff Sessions of Alabama and Florida Attorney General Pam Bondi also were in the crowd that filled the courtroom's 400 seats.

Outside the packed courtroom, marching and singing demonstrators on both sides ? including doctors in white coats, a Republican presidential candidate and even a brass quartet ? voiced their eagerness for the court to either uphold or throw out the largest expansion in the nation's social safety net since Medicare was enacted in 1965.

Republican presidential candidate Rick Santorum declared anew that GOP front-runner Mitt Romney has no standing to challenge Obama on the law since Massachusetts passed a somewhat similar version when Romney was governor. "If you really want Obamacare repealed," Santorum said outside the court, "there's only one person who can make that happen."

Later Monday, Romney said again he would repeal the law, calling it an unconstitutional power grab.

Afghans: US paid $50,000 per shooting spree death

Afghan villagers pray over the grave of one of the 16 victims killed in a shooting rampage in the Panjwai district of Kandahar province south of Kabul, Afghanistan, Saturday, March 24, 2012. (AP) ? The United States has paid $50,000 in compensation for each Afghan killed and $11,000 for each person wounded in the shooting spree allegedly committed by a U.S. soldier in southern Afghanistan, an Afghan official and a community elder said Sunday.

The sums, much larger than typical payments made by the U.S. to families of civilians killed in military operations in Afghanistan, come as the U.S. tries to mend relations following the killing rampage that has threatened to undermine the international effort here.

Army Staff Sgt. Robert Bales is accused of sneaking off his base on March 11, then creeping into houses in two nearby villages and opening fire on families as they slept.

U.S. investigators believe the gunman returned to his base after the first attack and later slipped away to kill again, American officials have said. Bales has been charged with 17 counts of premeditated murder and other crimes and could face the death penalty if convicted.

That would seem to support the U.S. government's assertion ? contested by some Afghans ? that the shooter acted alone, since the killings would have been perpetrated over a longer period of time than assumed when Bales was detained outside his base in Kandahar province's Panjwai district.

But it also raises new questions about how the suspect could have carried out the pre-dawn attacks without drawing attention from any Americans on the base.

The families of the dead, who received the money Saturday at the governor's office, were told that the money came from U.S. President Barack Obama, said Kandahar provincial council member Agha Lalai. He and community elder Jan Agha confirmed the payout amounts.

Survivors previously had received smaller compensation payments from Afghan officials ? $2,000 for each death and $1,000 for each person wounded.

Two U.S. officials confirmed that compensation had been paid but declined to discuss exact amounts, saying only that it reflected the devastating nature of the incident. The officials spoke anonymously because of the sensitive nature of the subject.

A spokesman for NATO and U.S. forces, Lt. Col. Jimmie Cummings, said only that coalition members often make compensation payments, but they are usually kept private.

"As the settlement of claims is in most cases a sensitive topic for those who have suffered loss, it is usually a matter of agreement that the terms of the settlement remain confidential," Cummings said.

However, civilian death compensations are occasionally made public. In 2010, U.S. troops in Helmand province said they paid $1,500-$2,000 for a death and $600-$1,500 for a serious injury.

The provided compensation figures would mean that at least $866,000 was paid out in all. Afghan officials and villagers have counted 16 dead ? 12 in the village of Balandi and four in neighboring Alkozai ? and six wounded. The U.S. military has charged Bales with 17 murders without explaining the discrepancy.

The 38-year-old soldier, who is from Lake Tapps, Washington, is accused of using his 9mm pistol and M-4 rifle, which was outfitted with a grenade launcher, to kill four men, four women, two boys and seven girls, then burning some of the bodies. The ages of the children were not disclosed in the charge sheet.

Bales is being held in a military prison at Fort Leavenworth, Kansas. The mandatory minimum sentence if he is convicted is life imprisonment with the chance of parole. He could also receive the death penalty.

Families of the dead declined to comment on any payments by U.S. officials on Sunday, but some said previously that they were more concerned about seeing the perpetrator punished than money.

Kandahar is the birthplace of the Taliban and remains a dangerous area despite several offensives.

In the latest violence, a bomb struck a joint NATO-Afghan foot patrol in Kandahar's Arghandab district late Saturday, killing nine Afghans and one international service member, according to Shah Mohammad, the district administrator.

Arghandab is a farming region just outside Kandahar city that has long provided refuge for Taliban insurgents. It was one of a number of communities around Kandahar city that were targeted in a 2010 sweep to oust the insurgency from the area.

The Afghan dead included one soldier, three police officers, four members of the Afghan "local police" ? a government-sponsored militia force ? and one translator, Mohammad said.

NATO reported earlier Sunday that one of its service members was killed in a bomb attack in southern Afghanistan on Saturday but did not provide additional details. It was not clear if this referred to the same incident, as NATO usually waits for individual coalition nations to confirm the details of deaths of their troops.

Understanding the Real Story of Your Business on the Web ...

by Mike Fleming

In the early days of the Web, all interaction with a business online
happened in one place ? on their website.? Businesses would create
content, put it on their site, and followers would come to the site and
consume the new content.? Measuring success was rather easy at that
point.? You simply tagged your site and one analytics tool would collect
all of your data for analysis.? Of course, we know this has all
changed.

Now, a business creates content and it gets published and
consumed in multiple places.? This fundamental shift in how the web
experience works brings with it a challenge in measuring success.?
When content is published and consumed offsite, the data is not
collected by your analytics tool.? Therefore, looking at visitors and
page views of your content no longer gives you the real story of your
success or lack thereof.

At this point, the Web analytics industry
is still evolving in regard to the challenge of collecting accurate
data about what happens on the Web.? Piecing together a story requires
multiple sources of data, as no one tool covers all of the needed
bases.? Not only that, but the way that the Web now experiences your
content requires different metrics to really understand how successful
you are.

I?m going to present to you what I?ll call ?metric
categories? that will help you to change your paradigm about what
success is on the Web and, therefore, help you to better analyze it.?
These categories will give you a sense of the types of metrics that you
should be looking through to identify the critical few that will help you grow your online presence.

1. Production ? am I worthy of customers?

If
you aren?t consistently creating killer content that is valuable to
your target audience, you are not worthy of success.? For a blog,
metrics like posts per week and words per post are great for monitoring
your end of the bargain in your online relationships.

2. Conversation ? how are my relationships developing?

Are
you interacting with your audience?? Are you getting comments on your
blog, reviews on your products, replies to your tweets, etc.?? Are the
comments people leave in-depth?? Are you leaving comments and responding
to your audience???? Metrics like comments per post, replies sent per
day and replies received per day can gauge your success in having
conversation with your audience.

3. Attraction ? what content is most successful at gaining attention?

Instead
of just blindly pushing content out into the plethora of spaces that
now exist, how about analyzing what your audience likes and doesn?t like
based on what they decide to consume and how much they interact with
it.? Metrics like CTR of link tweets or % of users that complete a video
can show you how you?re doing at delivering your content to your
audience in a way that interests them.

4. Attention ? is my content creating loyal followers?

Beyond
just attracting an audience, you want to keep their attention.? Is the
content you?re producing valuable enough to keep them coming back for
more?? Metrics like subscribers (Email or RSS), followers, likes, visits
per visitor, visitor loyalty and visitor recency are great for
measuring if people are becoming your fans.

5. Amplification ? what content spreads the most?

One
of the true powers of the Web is, of course, is how easy it is for your
fans to become evangelists and create more fans for you.? Free
marketing is golden!? Therefore, you want to measure and analyze how
well your content is spread by your audience.? Metrics like retweets per
thousand followers, links to your site, and blog authority can tell you
how well your influence is spreading and leading to more fans.

6. Conversion ? what content and sources lead to the outcomes I desire?

Of
course, we can?t forget outcomes.? How good is the sweat equity you?re
pouring into all these online relationships at leading customers into
your sales funnel and/or closing sales (whatever is appropriate).?
Metrics like Conversion Rate and AdSense clicks (for blogs) can help you
measure the activity, sources and content that is getting the job done
in this area.

There they are?6 categories of metrics for a Web
2.0 world.? Remember, while all of these are great, you don?t need all
of them all the time.? What you need to do is combine these broad areas
with the information from one of my previous posts about focusing on a few metrics
that are really important for the health of your business right now.?
Then, you?ll be well on your way to using your time wisely on what will
provide impact for your business.
